May 2012 Visa Bulletin Brings Significant Retrogression for EB2 China and India

The Department of State (DOS) has issued the visa bulletin for the month of May 2012. The Bulletin reports that, due to the rapid forward movement of the cut-off date, demand for China and India Employment Second preference numbers has increased dramatically during recent months, and at a much faster rate than had been expected. That has resulted in a retrogression with a cut-off date of August 15, 2007. While notices were included in the November, January, and February Visa Bulletins alerting readers to the possibility of such a retrogression, the retrogression has occured much earlier than anticipated. USCIS has indicated that it will continue accepting China and India Employment Second preference I-485 filings based on the originally announced April cut-off date. It is very important to have all EB2 filings completed before the end of April. If you need assistance with an I-485 Adjustment Application, please contact your GT attorney. GT LAW will also continue monitoring and reporting on availability as the updated by DOS.
