Attention Florida Homebuilders: New Laws Governing Homeowners’ Associations
Have Been Codified in the Florida Statutes

As discussed in our May 2004 Alert, the Florida Legislature has adopted
new rules governing Florida homebuilders and homeowners associations. The
two bills adopted by the Legislature and signed by the Governor — Senate
Bill 2984 and Senate Bill 1184 — have now been reconciled and codified in
Florida Statutes under Chapter 720, and the inconsistent statutory section
references have been corrected. Most notably, the required homeowners association
disclosure has been codified at Section 720.401, Florida Statutes, and not
720.601, as provided in Senate Bill 1184. Florida homebuilders should update
their contract materials to include the new disclosure with the correct
statute section references.
