Greenberg Traurig Attorney Peter Gluck Gives Quality Presentation on Intellectual Property Matters

COSTA MESA, July 13, 2005 – On June 14, 2005, Peter Gluck, an Intellectual Property attorney with Greenberg Traurig’s Orange County office, gave an invaluable presentation at a dinner program, entitled “Quality from an IP Perspective” for the Orange Empire Section 701 of the American Society for Quality. Approximately 55 members and guests, who attended to hear Gluck’s presentation, encompassed those affecting the quality of products and services from local industries, including stakeholders representing quality control, quality assurance, engineering, design and development, and inspection.

According to Gluck, the nature of IP, particularly Patent Law, has changed and it is increasingly important for those in the business community to be aware of these changes. "Patent Law has become more linear, and the need for people to advise you on monetizing your IP much more straightforward. Given the technology growth curve and the law's efforts to keep up, being able to recognize the IP sign-posts and milestones is more important than ever,” said Gluck. “From Stem Cells to Nanotechnology, IP is bringing together the worlds of patents and public funding, as has not been seen since the dot-com days.”

Gluck touched on the fundamental issues surrounding the conception, reduction to practice and filing of patent and trademark applications for engineers and protecting innovations. Gluck also addressed confidentiality, laboratory notebook practices, trade secrecy and related issues about documentation, publication and prosecution of patent applications. He highlighted some of the fundamental changes to the U.S. patent law and their impact on the design, manufacturing and commercial processes. He also touched upon enforcement, licensing and related matters.

Intellectual Property includes copyright, patent, trademark and related state law applying to technology, the arts and literature. It is a hot legal topic of which understanding is invaluable to both the business and general public. However, many people confuse patents, copyrights, and trademarks. Although there may be similarities among these kinds of intellectual property protection, they are different and serve different purposes. Knowing the legal implications and repercussions of the fluctuation in U.S. Patent and Trademark laws is especially important in today’s technologically advanced world.

Fundamental changes to U.S. Patent Law include the FESTO presumption that anything related to patentability involved in an amendment written during prosecution precludes any Doctrine of Equivalents, arguments for patentees and that no inference of willfulness arises from the lack of a non-infringement opinion in certain factual circumstances.

Gluck is an attorney with Greenberg Traurig LLP in Orange County and has spent his career counseling clients with respect to patents, trademarks, copyrights and related intellectual property matters. He has substantial experience in offering strategic patent asset management advice in the corporate setting. He has dealt with patent validity and infringement matters, licensing, valuation and collateral IP issues. Gluck has co-produced more than 400 U.S. Patents for clients across the technical spectrum, with a strong focus in the medical device industry.
