DOL Rule Allows for Electronic Filing of H-1B Labor Condition Applications

A new rule developed by the Department of Labor (DOL) will give employers the option of using an electronic filing system to file H-1B Labor Condition Applications (LCA). The new rule published on the December 5, 2001Federal Register and effective on January 14, 2002 will allow employers to submit their LCAs electronically through the DOL's website. Employers will still have the option of filing their LCAs by fax or mail.

The new system will utilize a new LCA Form ETA 9035-E which will be submitted through a DOL web site which is still under development. The new form will allow employers to file their applications without the submission of a hard copy of the ETA 9035 form. Moreover, the new system will provide guidance to employers "on line," avoiding incomplete or inaccurate entries, which should allow for immediate electronic certification of the LCAs.
