State and Local Police Authorized To Arrest Individuals on Immigration Violations

The Department of Justice, in a response to The Honorable Edward M. Kennedy (who had requested information about a recent opinion by the Department's Office of Legal Counsel), affirms the deputizing of state and local police to detain or arrest foreign nationals whose name has been entered into the FBI's National Crime Information Center (NCIC) database.
