Final Rule on Automatic Visa Revalidation

The Department of State has adopted the interim rule regarding Automatic Visa Revalidation as final, effective August 18, 2003. Two important changes were put in effect with the interim rule.

The Automatic Visa Revalidation program still allows certain nonimmigrants to reenter the United States with expired visas after visits to Canada or Mexico for less than 30 days. Keep in mind that if the purpose of the visit to Canada or Mexico is to renew a visa and the application is denied, the applicant must first obtain a new visa from a U.S. consulate in their home country before they may return to the United States. Please also note that nationals of countries that are state sponsors of terrorism are not eligible for automatic visa revalidation, and must always have a valid visa in the appropriate classification to enter the United States.
