DHS Proposes Collection of Fees for F, J and M Nonimmigrant Visas

The Department of Homeland Security (“DHS”) is proposing regulations which will require certain aliens applying for certain F-1, F-3, J-1, M-1 or M-3 student visas to pay a fee to DHS. In most instances visa applicants will pay $100, however certain J-1 programs will only pay $35 and other categories will be exempt altogether . The proposed fees will cover the costs of administering and maintaining the SEVIS system as well as provide for the hiring of SEVIS and other ICE officers to ensure compliance with SEVIS requirements. DHS is soliciting written comments on the proposed rule until December 26, 2003.
