Number of H-1B Filings not as High as Expected

The USCIS has indicated it has NOT seen the expected spike in H-1B filings this month as expected. Due to the lower H-1B numbers (65,000), most in the immigration community expected an avalanche of sorts in Fiscal Year 2005 H-1B filings beginning April 1st, when employers were again permitted to file cap-subject petitions with start dates beginning October 1, 2004 or later. Instead, USCIS representatives indicated that, although they cannot provide precise numbers, the volume has been “surprisingly low.”
