Electronic Signature and Storage of Form I-9

On May 11, the interim final rule entitled, "Electronic Signature and Storage of Form I-9, Employment Eligibility Verification" cleared the Office of Management and Budget (OMB) following initial review. The rule has now passed through OMB and it must go back to Immigration and Custom Enforcement (ICE) for final review and approval. If ICE approves the rule, it will be published in the Federal Register. This rule implements statutory changes to the Form I-9 retention requirement that President George W. Bush signed into law on October 30, 2004 as reported previously by GT.

The business community is awaiting the rule which will set standards for electronic signatures and the electronic retention of the Form I-9.
