Arizona State Law and the Ninth Circuit
CPLC v. Napolitano, Sept. 17, 2008: Upon review of the Arizona state
law, Legal Arizona Workers Act, which took effect January 1, 2008, the
Ninth Circuit Court of Appeals determined that the Act's licensing laws,
including sanctions to revoke business licenses from employers who hire
illegal aliens as well as the state-wide requirement for employers to
register and use E-Verify, are not preempted by federal law or policy.
This determination is a conservative analysis of the conflict between
state and federal law which is a departure for the Ninth Circuit.
