District Court Overturns Illinois E-Verify Prohibition

A District Court in Illinois overturned the Illinois Act, which prohibited employers from participating in E-Verify until the Social Security Administration and Department of Homeland Security databases are able to make a determination on 99 percent of the tentative nonconfirmation notices issued to employers within three days. The Court ruled that the Illinois Act was unconstitutional because it violated the Supremacy Clause, meaning that the Illinois Act prevented the execution of federal immigration laws. United States of America v. State of Illinois ( C. D. IL, 3/12/09).
