USCIS Provides Latest Count on FY 2010 H-1B Cap Petitions

On April 20, 2009, USCIS reported that it had received 44,000 cap-subject H-1B petitions out of the 65,000 permitted by Congress for the 2010 fiscal year. USCIS reported that it has received approximately 20,000 of the 20,000 first-time H-1B petitions exempt from the cap based on the beneficiaries’ receipt of U.S. Master’s degrees or higher, but that it will continue to accept them based on the likelihood that not all petitions from that first batch will be approvable.
