New I-129 Form and Instructions

CIS announced that a revised Form I-129 Petition for Nonimmigrant Worker, as well as the new instructions will go into effect on November 23, 2010, and must be used after December 21, 2010.  There are several changes to the new I-129, including questions about the beneficiary's previous J-1 status (if applicable), questions about off-site work locations (if applicable), and a new certification section requiring the employer to attest that it is in compliance with the Export Administration Regulations (EAR) and the International Traffic in Arms Regulations (ITAR).
