Update on Department of Justice's Plans to Interview 5,000 Foreign NationalsINS recently indicated that when INS agents are not present at the interviews of approximately 5,000 foreign nationals who fit the criteria listed in the November 9, 2001 memo (summarized in Greenberg Traurig’s November 19th Alert) and the interviewer suspects that a particular individual is in violation of his or her status, the Department expects the law enforcement officials to refer the case to the INS. According to INS sources, local INS managers have been instructed to provide agents at various locations to ensure that an INS agent can immediately respond if a state or local law enforcement officer suspects an immigration law violation.
