Exchange Visitor Program Reinstated

GT successfully overturned the revocation of an exchange visitor program. This unprecedented case against the State Department was remanded for additional administrative hearings after a Federal District Court found that the original administrative decision was "Inexplicably Devoid" of Evidence. In November 2001, the State Department began the administrative process to revoke the cultural exchange designation for the client. The client was designated to bring in foreign hospitality professionals to train them in American techniques. After three days of intense revocation proceedings in which the State Department essentially had no outside witnesses, an administrative panel upheld the State Department position. GT appealed to the Federal District Court in Charleston, SC. This was the first of such cases relating to the exchange visitor program. In a decision dated November 26, 2002, the court held that the State Department acted irrationally and without sufficient evidence and remanded to State. In a 52-page decision dated November 19, 2003 the Department of State's Exchange Visitor Program Designation, Suspension and Revocation Board reversed its earlier revocation of the J-1 program for the American Hospitality Academy.
