Update on PERM Cases

Following the one year anniversary of the new PERM program, at a recent meeting the Department of Labor provided some updates on pending PERM cases since its implementation in March 2005.

Number of Cases Filed 80,272
Number of Cases Certified 36,687
Number of Cases Withdrawn 1,950
Number of Cases Denied 23,205
Number of Audits 24,969

From these figures, it appears that the success rate of a PERM application has been approximately 45%, which is not a comforting thought to many of you who have or are preparing to file PERM cases. Keep in mind that the initial launch of PERM in March 2005 was met with many system glitches that have since been resolved. Although we have seen some improvement in the PERM process, the DOL realizes that there are many more issues that must be resolved before the success rate of approved cases increases.
