E-Verify Background
Section 401 of the
Illegal Immigration Reform and Immigrant Responsibility Act of
1996 (IIRIRA - Public Law 104-208) required the federal
government to establish pilot programs to verify the employment
eligibility of new hires.
E-Verify Updates
E-Verify Program Highlights
E-Verify is a voluntary web-based system that
electronically verifies the employment eligibility of
newly-hired employees. The Department of Homeland Security
(DHS) and the Social Security Administration (SSA) created
E-Verify in a joint effort. Oversight of the program is handled
by the U.S. Citizenship and Immigration Services (USCIS).
E-Verify is a re-branding of its predecessor, the Basic
Pilot/Employment Eligibility Verification Program; previously in
existence since 1997. E-verify program improvements include a
new Photo Screening Tool that helps employers detect forged
immigration documents. E-Verify also allows participating
employers to electronically compare employee information taken
from the Form I-9 (the paper-based employment eligibility
verification form used for all new hires) against more than 425
million records in SSA's database and more than 60 million
records in DHS' immigration databases. Results are returned
within seconds.
Employers: How Do I Register?
An employer's participation in E-Verify is voluntary
and is currently free to employers. To participate, an employer
must register online at
https://e-verify.uscis.gov/entroll/StartPage.aspx?JS=YES
and accept the electronic Memorandum of Understanding (MOU) (http://www.uscis.gov/files/nativedocuments/MOU.pdf)
that details the responsibilities of SSA, DHS, and the
employer. Companies wishing to participate in E-Verify, as an
E-Verify user, designated agent, or corporate administrator, or
for more information on the web-service access method, should
visit:

Designated Agent
Businesses wishing to choose an outside company, or Designated
Agent, to conduct E-Verify on their behalf, must register and
sign a MOU that sets forth the responsibilities of the
Designated Agent, the USCIS and the SSA. The company must also
enter into a MOU with the Designated Agent, the USCIS and SSA
establishing and defining the responsibilities for all parties.
